      随着人类对空间利用能力的不断提升,专有权最大化原则与鼓励交易原则将是判断某种空间能否作为独立物的标准;随着权利冲突现象的不断增多,如何适当限制财产性权利权能是妥善解决问题的根本。地下车位作为现代高层建筑快速发展的产物已适用上述原则,并被《物权法》明确具有专有权属性,但现有法律并未对其进行权利限制也带来了一些问题,亟需在立法中加以完善。
英文摘要:
      With the consistent development of human beings’ competence on the utilization of the space, the principle of maximization on the exclusive rights and the principle of encouraging the trade would be regarded the criterion of judging whether a space could be regarded as independent property. The foundation of solving the problem is how to limit the property rights and functions with the increase of the conflicts among the rights. Underground parking space is the product of the fast development of modern high-rise buildings, and the principles mentioned above could be applied to it. And it has been also endowed with the exclusive rights by the property law. However, the property law has not limited the exclusive rights, resulting in some problem. These problems should be solved by legislation.
