随着人类对空间利用能力的不断提升,专有权最大化原则与鼓励交易原则将是判断某种空间能否作为独立物的标准;随着权利冲突现象的不断增多,如何适当限制财产性权利权能是妥善解决问题的根本。地下车位作为现代高层建筑快速发展的产物已适用上述原则,并被《物权法》明确具有专有权属性,但现有法律并未对其进行权利限制也带来了一些问题,亟需在立法中加以完善。 |

With consistent development of human competence in utilization of space, the principle of maximization on exclusive rights and the principle of encouraging trade are viewed as criterion to judge whether a space should be regarded as independent property. Rights conflicts are on the rise and the solution lies in proper restriction of property rights and functions. As a result of the fast development of modern high-rise buildings, underground parking space emerges to which the principles mentioned above can be applied and also endowed with the exclusive rights by the property law. However, its exclusive rights are not restricted by property, resulting in some problems which should be solved by legislation. |
